1. Introduction
These Terms and Conditions govern the sale of automotive batteries and related products by WeGotBatteries and regulate all warranty claims, replacement services, protection plans, and related services offered through the WeGotBatteries platform.
By purchasing a battery or related product through WeGotBatteries, the customer agrees to be bound by these Terms and Conditions.
2. Definitions
2.1 “WeGotBatteries”
Means WeGotBatteries, an online automotive battery retailer, facilitator and service platform operating within the Republic of South Africa and neighbouring territories where applicable.
2.2 “Customer”
Means the original purchaser and end user of the battery purchased through WeGotBatteries.
2.3 “Manufacturer”
Means the manufacturer of the battery purchased by the Customer.
2.4 “Authorised Fulfilment Partner”
Means an approved installer, fitment centre, technician, retailer or service provider authorised by WeGotBatteries to conduct battery testing, installations, removals, replacements, inspections and related services.
2.5 “Protection Plan”
Means any optional paid or complimentary replacement or mobility protection product offered by WeGotBatteries.
2.6 “Warranty Claim”
Means a claim submitted by the Customer alleging that a battery has failed due to a manufacturing or workmanship defect during the applicable manufacturer warranty period.
3. General Product Warranty
3.1
All batteries sold through WeGotBatteries are subject to the applicable manufacturer’s warranty terms and conditions.
3.2
WeGotBatteries is not the manufacturer of the batteries sold and does not independently manufacture, remanufacture or modify batteries unless expressly stated otherwise.
3.3
Manufacturer warranties generally cover defects in material and workmanship only and remain subject to manufacturer inspection, testing and approval.
3.4
Warranty periods differ between brands and battery models and will be communicated at the point of sale where applicable.
4. Customer Responsibilities
The Customer shall:
a) Ensure the correct battery type and specification is selected for the vehicle or application;
b) Ensure the vehicle’s charging and electrical systems are in proper working order;
c) Retain proof of purchase;
d) Ensure the battery is used only for its intended automotive starting purpose unless otherwise specified;
e) Notify WeGotBatteries of any alleged defect or failure as soon as reasonably possible.
5. Warranty Claim Process
5.1
A Customer who believes a battery is defective must contact WeGotBatteries and provide:
a) Proof of purchase;
b) Vehicle details;
c) Description of the failure or complaint;
d) Photographs or supporting evidence where requested.
5.2
The Customer may be required to make the battery and/or vehicle available for inspection, testing and diagnostic procedures.
5.3
WeGotBatteries or its Authorised Fulfilment Partner may conduct preliminary testing including but not limited to:

Voltage testing;

Load testing;
-
Charging system testing;
-
Visual inspection.
5.4
The battery may be removed and submitted to the manufacturer, distributor or authorised laboratory for further inspection and validation.
5.5
Final approval or rejection of a standard manufacturer warranty claim remains at the discretion of the relevant manufacturer or authorised distributor.
6. Instant Replacement And Protection Plan
6.1
Customers who purchase a qualifying WeGotBatteries Protection Plan may be eligible for immediate replacement of a failed battery prior to final manufacturer assessment.
6.2
Eligibility for instant replacement shall be determined solely by WeGotBatteries based on:
a) Diagnostic test results;
b) Battery age;
c) Vehicle charging system condition;
d) Battery condition;
e) Claim history;
f) Compliance with these Terms and Conditions.
6.3
Where an instant replacement is approved:
a) The failed battery becomes the property of WeGotBatteries for claim processing purposes;
b) The replacement battery supplied shall continue only for the remaining balance of the original manufacturer warranty period unless otherwise stated;
c) WeGotBatteries reserves the right to recover costs from the Customer if the claim is subsequently found to be fraudulent, abusive, negligent or excluded under these Terms and Conditions.
6.4
WeGotBatteries reserves the right to refuse instant replacement where:
a) Diagnostic requirements are not met;
b) The vehicle has charging or electrical faults;
c) There is evidence of abuse, neglect or misuse;
d) Fraud or misrepresentation is suspected.
7. Exclusions
Any warranty claim or Protection Plan benefit shall be null and void if any of the following apply:
7.1 Incorrect Application

Incorrect battery type or specification;

Incorrect installation;
-
Use in applications for which the battery was not designed.
7.2 Vehicle Faults

Faulty alternator;
-
Electrical drain;
-
Starter motor faults;
-
Wiring defects;
-
Non-standard electrical modifications.
7.3 Abuse or Neglect
-
Deep discharge;
-
Failure to maintain charge;
-
Overcharging;
-
Undercharging;
-
Physical damage;
-
Damaged terminals;
-
Cracked casing;
-
Improper securing or mounting;
-
Exposure to fire, flooding, collision or Acts of God.
7.4 Non-Automotive Use
-
Solar systems;
-
Backup power systems;
-
Industrial equipment;
-
Commercial cycling applications unless specifically approved.
7.5 Fraud and Misrepresentation
-
False information;
-
Tampered serial numbers;
-
Altered labels or date codes;
-
Missing proof of purchase.
7.6 High-Risk Usage
Unless expressly covered:
-
High-load auxiliary electrical systems.
7.7 Normal Wear and Tear
Batteries that have reached the end of their reasonable service life or which can be recharged and returned to service are not considered defective.
8. Limitation Of Liability
8.1
WeGotBatteries shall not be liable for:

Loss of income;
-
Loss of use of vehicle;
-
Towing costs;
-
Accommodation costs;
-
Consequential damages;
-
Indirect damages;
-
Third-party damages.
8.2
To the fullest extent permitted by law, WeGotBatteries’ liability shall be limited to the replacement, recharge or repair of the battery where applicable.
8.3
WeGotBatteries acts as a retailer and facilitator and does not independently guarantee manufacturer warranty approvals.
9. Claim Investigation
9.1
WeGotBatteries reserves the right to:

Inspect any battery;

Conduct diagnostic testing;
-
Request vehicle inspection reports;
-
Obtain independent technical assessments;
-
Refuse claims where fraud, abuse or negligence is suspected.
9.2
The Customer agrees to cooperate fully with all reasonable investigation procedures.
10. Consumer Protection Act
Nothing contained herein limits any rights afforded to consumers under the Consumer Protection Act 68 of 2008 where applicable.
However, all claims remain subject to proper diagnostic procedures, investigation and validation.
11. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.
12. Amendments
WeGotBatteries reserves the right to amend these Terms and Conditions from time to time without prior notice. The latest published version shall apply.
