Welcome to WEGOTBATTERIES. The terms “we”, “us” and “our” refer to WEGOTBATTERIES (PTY) LTD. We operate the online store at www.wegotbatteries.net, including all related content, features, products and services (the “Services”).

These Terms of Service (“Terms”), together with our Privacy Policy and any other policies referenced herein, govern your use of the Services. Please read them carefully.

By visiting, browsing or purchasing from our Services, you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use our Services.

These Terms are governed by and comply with South African law, including the Consumer Protection Act 68 of 2008 (“CPA”), the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”), and the Protection of Personal Information Act 4 of 2013 (“POPIA”). Nothing in these Terms limits or excludes any rights you have under applicable South African law.

Section 1 – Access and Account

By agreeing to these Terms you confirm that you are at least 18 years of age, or that you have the consent of a parent or legal guardian. Persons under 18 may not transact on our store without appropriate parental or guardian consent.

To purchase from us you may be required to provide personal information including your name, email address, delivery address and payment details. You warrant that all information you provide is accurate, current and complete.

You are responsible for maintaining the confidentiality of your account login credentials and for all activity on your account. You may not transfer or assign your account to any third party.

Section 2 – Our Products

We take care to represent our products accurately. However, colours and product appearance may vary depending on your device display settings and we cannot guarantee an exact match.

Product descriptions, pricing and availability are subject to change without notice. We reserve the right to limit quantities or discontinue any product at our discretion, provided we honour orders already confirmed.

Section 3 – Orders

Placing an order constitutes an offer to purchase. No contract is formed until we confirm acceptance of your order. We reserve the right to decline any order. If we cannot accept your order, we will notify you at the email or phone number provided and issue a full refund of any payment received.




Order cancellations and returns are governed by our Refund Policy, which complies with the CPA.

You warrant that purchases are for personal or household use and not for commercial resale, unless you have entered into a separate wholesale or reseller agreement with us.

Section 4 – Prices and Payment

All prices are displayed in South African Rand (ZAR). Unless stated otherwise, displayed prices exclude VAT, shipping, and any applicable handling charges, which will be shown before checkout confirmation.

VAT is charged at the current statutory rate where applicable.

Prices are subject to change without notice. The price applicable to your order is the price confirmed at checkout and reflected in your order confirmation.

We accept the following payment methods: Credit/Debit Card via PayFast, EFT, Instant EFT. Payment must be received and verified before an order is processed and dispatched.

You warrant that you are authorised to use the payment method provided and that the payment details you supply are accurate and complete.

Section 5 – Shipping and Delivery

We deliver to addresses within the Gauteng urban areas in South Africa. Rural and outlying areas as well as other provinces will follow. 

All delivery timeframes provided are estimates only and are not guaranteed. We are not liable for delays caused by third-party couriers, extreme weather, or other events beyond our reasonable control.

Risk of loss or damage to goods passes to you upon delivery to the address you specified. If a delivery is missed, our courier will follow their standard redelivery or collection procedure.

Section 6 – Returns, Refunds and Consumer Rights

You have the following rights under the CPA, which we honour in full:

  • Right to cancel a direct marketing transaction within 5 business days of receiving goods (“cooling-off period”)

  • Right to return unsafe, defective or incorrectly described goods within 6 months of delivery for a refund, replacement or repair at your election

  • Right to return goods that do not match a sample or description

Additional return and exchange conditions are detailed in our Refund which must be read together with these Terms. Our Refund Policy may offer rights beyond the CPA minimums but may not restrict the CPA rights set out above.

Refunds will be processed using the original payment method within a reasonable time.




Section 7 – Intellectual Property

All content on our Services, including text, images, graphics, logos, product descriptions, video and design, is owned by or licensed to WEGOTBATTERIES (PTY) LTD and is protected under South African and international copyright and intellectual property law.

You may use our Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, or republish any content without our prior written consent.

The WEGOTBATTERIES name, logo and trademarks may not be used without our express written permission.

Section 8 – Third-Party Links and Tools

Our Services may include links to third-party websites or integrate third-party tools (for example, payment gateways or shipping tracking portals). These are provided for convenience only.

We are not responsible for the content, accuracy, or privacy practices of any third-party site or service. Your use of third-party services is subject to their own terms and conditions.

Section 9 – Privacy

We collect and process your personal information in accordance with our Privacy Policy and POPIA. By using our Services, you confirm you have read and understood our Privacy Policy.

Section 10 – User Feedback and Reviews

We welcome feedback, product reviews and suggestions. By submitting any feedback, you grant us a royalty-free licence to use, reproduce and publish it for the purposes of operating and improving our Services.

You warrant that any feedback you submit is your own, is accurate, does not infringe any third-party rights, and does not contain unlawful, defamatory or harmful content. We reserve the right to remove feedback that violates these requirements.

Section 11 – Errors and Inaccuracies

We strive for accuracy but occasional errors in pricing, product descriptions or availability may occur. We reserve the right to correct any such errors and, where an order has been placed based on an error, to offer you the option to proceed at the corrected price or cancel for a full refund.

Section 12 – Prohibited Uses

You may only use our Services for lawful purposes. You may not:

  • Use our Services for any unlawful, fraudulent or harmful purpose

  • Violate any applicable South African law or regulation

  • Infringe our intellectual property or the intellectual property of others




  • Transmit any viruses, malware or harmful code

  • Attempt to gain unauthorised access to our systems or accounts

  • Scrape, harvest or extract data from our Services without our written consent

  • Impersonate any person or entity or misrepresent your identity

  • Engage in any conduct that disrupts or interferes with our Services

We reserve the right to suspend or terminate your access if you violate these Terms.

Section 13 – Automated Access and Agents

You may not use automated tools, bots, scrapers or AI agents to access, interact with or extract data from our Services without our prior written consent. Any automated access must identify itself in the HTTP user-agent string and comply with any restrictions we communicate.

Section 14 – Disclaimer of Warranties

We make reasonable efforts to ensure our Services are accurate, reliable and available. However, to the extent permitted by applicable law, we do not warrant that:

  • Our Services will be uninterrupted, error-free or free from harmful components

  • Product information, pricing or availability will always be accurate or current

Nothing in this section limits any implied warranty or consumer right that cannot lawfully be excluded under the CPA or any other applicable South African legislation.

Section 15 – Limitation of Liability

To the fullest extent permitted by South African law, WEGOTBATTERIES (PTY) LTD will not be liable for any indirect, incidental, special or consequential loss or damage arising from your use of our Services, including lost profits or data, provided that:

  • We remain fully liable for direct loss caused by our negligence or breach of contract

  • We remain fully liable for harm caused by defective or unsafe goods as contemplated by the CPA

  • We remain fully liable where the law does not permit limitation of liability

Where our liability is not excluded by law, it is limited to the value of the goods or services that gave rise to the claim.

Section 16 – Indemnification

You agree to indemnify and hold harmless WEGOTBATTERIES (PTY) LTD and its directors, employees and agents from any claims, damages or costs (including reasonable legal fees) arising from: (1) your breach of these Terms; (2) your violation of any applicable law; or (3) your use of our Services in a manner that causes harm to a third party.

This indemnity does not apply to the extent that any claim arises from our own negligence or breach of applicable law.





Section 17 – Termination

We may suspend or terminate your access to our Services at any time if you breach these Terms, with or without prior notice. On termination, all outstanding amounts you owe remain payable.

Sections relating to Intellectual Property, Feedback, Indemnification, Limitation of Liability, Governing Law and any provisions that by their nature should survive, will continue to apply after termination.

Section 18 – Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be severed and will not affect the validity of the remaining provisions.

Section 19 – Waiver and Entire Agreement

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with our Privacy Policy and any other policies incorporated by reference, constitute the entire agreement between you and us regarding your use of our Services and supersede all prior agreements on the same subject matter.

Section 20 – Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. WEGOTBATTERIES (PTY) LTD may assign or transfer these Terms or any of its rights under them without your consent, provided this does not prejudice your statutory rights.

Section 21 – Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from or relating to these Terms or our Services will be subject to the jurisdiction of the South African courts, specifically the courts of Gauteng / Western Cape / KwaZulu-Natal.

Nothing in this clause limits your right to approach any consumer tribunal or the National Consumer Commission as provided for under the CPA.

Section 22 – Electronic Communications (ECTA)

In accordance with the Electronic Communications and Transactions Act 25 of 2002:

Section 23 – Changes to These Terms

We may update these Terms from time to time. The current version will always be available on our website with a “Last Updated” date. We will notify you of material changes via email or a prominent notice on our website. Your continued use of our Services after any changes constitutes acceptance of the updated Terms.
